I think it would be more likely to happen in the reverse order. Get drunk first, THEN steal a train.

In Illinois you can get a DUI driving a ten foot dinghy if it has a trolling motor.

In Nebraska anything with wheels. Yes folks getting drunk at the roller rink and then trying to skate home can net you a dui.

Do you need a driver's license to skate? No.
Can you skate when you're 12? Yes.
Can you drive when you're 12? No.
It just needs someone to fight it. Easily challenged.

The whole reason the law was wrote was because multiple dui offenders were using tractors, riding mowers and motorized bikes to go to stores and bars and operating drunk. There was a guy who challenged a dui conviction on a mower. He was still charged, and then they rewrote the law to encompass anything with wheels because drunk rednecks will find a way to propel anything. I have never hear of anyone actually being charged while roller skating, but the way the law is wrote. They can.

Politicians gotta learn that they're not "lawmakers" as statists like to call them. They gotta learn that the people are gonna do what they're gonna do and at some point, if they keep making bullshit laws, mobs of constituents are eventually going to drag them out of their offices and fillet them with rusty lawnmower blades.

I still wager that you could fight that law because skating is not driving in any way whatsoever.
the problem is, it would have to be fought by someone who is not currently being charged under it.
