I failed a drug test , but the truth is more disturbing than that and this is a story every Trucker needs to share not only with fellow truckers but anyone who gets drug tested because this can happen to ANYONE and has including even police who are trained to recognize when someone is under the influence of drugs and even police have been unaware of what was happening or done to them .
You need to read this but first I need to stress , I DO NOT USE DRUGS . I don't let Doctors even prescribe me pain medication. I use NOTHING but Motrin IB for arthritis and joint pain . I have never until recently failed a drug test for any job in 30 years , yet I definitely failed one recently and driver's , especially women , need to be aware of a rising problem.
I just finished my SAP program , which she ,my c.a.p and the tech who reported my test all agree I don't use drugs . Actually the only people that seem to believe me are the ones actually trained to detect drug abuse. I even won my unemployment appeal based on the techs actual evidence . Yet getting back to work has not been easy .
To really understand this situation you need to be aware that the company I worked for did their own random screenings and it was Hair follicle testing , which I'm told can't really be beat without weeks of preparation. I have never failed one , including the one I had only 2 to 3 weeks prior to my D.O.T Random .
So how did I fail my drug test?
Well it all started with a night of bar hopping and clubbing in Daytona Beach FL. It was quite the epic night and we went to lots of places that tended to attract the ladies . We are not sure when , how , or at what establishment but sometime during the night , I got a drink that was likely not meant for me ( there is a possibility that a jolly rancher given to me was the culprit but we're really not sure , but being that so many women were present it stands to reason that my drink got mixed up with a females spiked drink . Good news for her... Not so good for me . )
Problem with all these THC OILS and candy and powder that can be mixed right into a drink , is that the effects build up slowly. Now if I had ONE DRINK that night I would have been aware that something was wrong but I had two days to recover and I hadn't been out or drank in months so I was trying to get drunk and have fun . Irony of that night is my brother joked about me being roufied during the following days because they got me into a strip club with no restraint on my part . ( I really don't like strippers or strip clubs ) But we never gave it much credibility because other than a case of food poisoning I felt fine . No hangover or anything.
Long story short night passed by and I almost forgot about the night . It wasn't till the tech called me about my test results and asked if I am dating or living with anyone that uses marijuana. At first I was confused but he went on to explain to me what the numbers are for people who even only smoke a joint of today's marijuana and that my numbers were to low for marijuana use . Problem was my numbers did exceed The DOT limits .
This is why Woman especially have to be concerned. He said my numbers were what he would find if I was a woman who didn't smoke marijuana but recently was intimate with a male chronic smoker . He even said I could kiss a chronic smoker hours before my test and have almost the same numbers . ( Yes you do not need to use marijuana to fail a drug test ) . He also pointed out that he had access to my prior drug tests , including the recent follicle test and he could say with certainty that I was exposed to something but it does not add up to use . He explained how a regular user of today's marijuana shows 100s of times the level tested for . A one time smoker would show many times more for days following and problem was my follicle test would have shown a failure in order for the number I was showing so soon later .
See I showed 4 times what is tested for , which is 60 ng but in order to show that number my hair follicle test would have shown a high concentration. Furthermore because of the time in between the two tests it was impossible, except for old school homegrown , for my numbers to be as low as they were . And just so you know , I would have had to smoke the homegrown that morning of the test to still show the 60ng , but that's the stance DOT is taking . I was smoking pot in my truck . I know that sounds ridiculous but fact is because it's POSSIBLE , DOT says it's fact. ( But remember I said I had food poisoning? He did say since that was the weekend following my hair follicle test , that the timeline and numbers as well as what I thought was food poisoning all solidify in his experience that I did actually ingest it and being that I was in a setting were some might use THC products with nefarious intent , that he did believe I unknowingly ingested it . )
Whole point to this story is I have proven to all the specialist that I am drug free and have a drug free history and even a recent appeals hearing was decided in my favor because even they agreed that all the evidence shows that though I was fired for failing a drug test , my firing could not be labeled as MISCONDUCT because all the evidence shows that I was unknowingly drugged . Not just the scientific evidence but even my own work history and the fact that at 44 years old there is absolutely nothing anywhere in my files that even show any kind of substance abuse or even alcohol abuse .
Long story short I am that one in a million story of the old " I AM INNOCENT" That is actually true . But the bigger issues are one , the information the doctor gave me , which both my SAP and C.A.P confirmed and the situation in which I was drugged . For female truck drivers the chances of experiencing what happened to me are multiple many times over . Fact is that if it was a mix up of drinks I possibly saved a woman from being a victim that night .
For myself this still isn't over . I have actually proven myself innocent even in the eyes of not just a court but also in the eyes of actual trained experts and I still am having trouble getting back into a truck . For anyone that is wondering I also have both a flawless MVR , A clean DAC and a PERFECT CSA score with over 800,000 miles and seven years under my belt .
