Oh Sean, it all depends on each person and what they can or cannot do hon. Its not easy life like so many feel it is
for the part of all duties required for driving I was glad see there are some that still are by book drivers.
Been out here many years hon,gets be old news and the thrill is gone, more now for me a way pay debts, my home, other
necessary life and day to day things. Not easy life, I hope and pray that you see by reading other things on this site, lifestyles
of the Truckers in the USA.

Definately agree with you (first sentance). I NEVER had any delusions about this being either good paying or easy. And I was NOT looking for the typical 9 to 5. But I sure did not expect or need the un-necessary B.S. I was handed to get me to quit or be fired to help in the cause. I knew the lifestyle. I was not a driver, but I have known drivers for decades. I was not as delusional as most trying to get into this. I still want to drive, but not for too long a stretch of time. And that should be quite satisfactory to most companies since more experience means more expensive miles.

I've been doing this going on 8 yrs now and i
m strickly OTR.I stay out a month at a time sometimes longer.I personally don't think it's a hard life style like so many think.I guess because I really enjoy being out here and I don't let pety ass crap get the best of me.Plus I don't have a husband waiting for me at home.So staying out is perfect for me.I don't go strickly by the book.If we all did that,we would'nt be making any money.I don't get creative on the miles.What I drive is what I log but I do is sitting at the shp and receiver too long and my 10 hr brk.Sometimes I have to get to the cust and no way would I make it if doing a stupid 10 hr brk.I dont know about the rest of u but I can function just fine on 6 hrs of sleep aday.Only time I ever take a long sleep brk is when the load has alot of window time and even then I dont need that much sleep.

Logging is an issue with some companies out there in that they pretty much REQUIRE you to log line 1 whenever the wheels are not turning, just because you are not paid, and they THINK it's YOUR time. I know every driver does it to avoid a possible 34 (well maybe there is one or two others like me out there LOL), but I won't, but I was NEVER on line 4 when I should not have been. Maybe I would not have had that issue with Swift, but the other company gave me a problem over it, and I think that is why I was given a hard time and pushed up load times. Maybe Swift does do the same thing, so writing this here applies too.

I am the same as you - no home ties to worry about - no wife and kids (which I said a few times before). Okay by me that you and others don't go strictly by the book, but I should not be penilized for doing so. I have NEVER done anything illegal or wrong with my logs, but the other company I worked for did not like it because MAYBE I'd have to do a 34. Well - TOUGH. If they can have a truck sitting 3 and 4 days because it's a veteran driver making more per mile, I can sit 34 hours to get what may be a needed rest and rejuvenating time. As long as I am LEGAL in how I log, NO company has the right to fault me for it. And what does any driver care what I do? Hey, if anything, my logging legal just frees up a load or two for a driver who really wants and needs it. I see too many experienced drivers who paid their dues sitting too long because they make more per mile. Not fair. But some of these comapnies want to push a new driver like they have 10 years experience out there. IF I really wanted to, I could handle it. But I won't because I know I am being taken advantage of, and I have seen too many on the same region as me sitting and starving. I too can get by on 6 Hrs sleep, but I won't do it everyday. Working what would technically be more than 70/8 to make $800.00 or so (gross) is not my goal. And I go by the book to ensure I will always be alert. In truth, going by the book only had me do a 34 ONE TIME. Other 34 hour resets came because I was waiting for a load anyway, or it was a weekend when things are slower. Heck, as it is trucking can get almost two thirds of your life being on duty being totally by the book. On top of which you are still technically with the job because the truck is home. I am not giving any more than that :).

Right now, going totally and completely by the book is more taboo than usual because of the economy. Don't cheat in ways everyone gets away with, and the company screws you. Cheat and get caught by a D.O.T. officer who has something to prove, he screws you. Or worse, drive groggy and worse things will happen eventually. Not gonna happen with me. I'll pay my dues not making much money, or not getting the best runs. I will NOT pay my dues logging contrary to anything in the book whatsoever. This I do for MY benefit.

Anyhoooo, we'll see what happens. Stay safe out there.
 
I could'nt agree with u even more,no driver should get penalized for running legal.But unfortunately it'll happen till the end of time.Only thing companies have on their mind and always will is MONEY,MONEY,MONEY,they could care less about the drivers.I don't go strickly by the book even if when I have alot of window time on some loads.If i'm not tired i'm not going to sit at some boring stale truckstop because of the stupid HOS rules.Nobody is going to tell me when I need to stop driving and when i'm allowed to start back up.When I feel refreshed and ready to go i'm going to do so even if only 4 hrs of sleep.But i'm not going to condem the drivers that do go strictly by the book,that's their choice.All companies want u to be legal to a certain point but u had best have the legal hrs to make that load ontime otherwise u will hear about it which intime may result in suspension or termination if u dont make ontime delivery because you're on your 10 hr brk too many times.You know what im saying?Sean I do respect you for a going by the book type of guy and hopefully your dispatcher can find u loads that works with your hos schedule.Now me on the other hand,I could giving a flying rats ass about the HOS,LOL. Thanks for respecting my "by the book" ways. And thanks for stating what I have known (drivers or their CDL not being cared about). So it's up to me. All well and good most drivers think HOS rules are "stupid", but in my mind, they are not. There's a reason, and 9 out of 10 truck wrecks I have seen confirm the reason (I have pics I can post of a real nice wreck I saw - the driver ran off the road on I-81 prior to an exit about a half hour south of Winchester, Va last year. His exit from the highway was gradual - indicitive of falling asleep at the wheel - not gonna be me someday because I take the attitude that F.M.C.S.A./D.O.T. HOS rules are stupid). 1: I am only giving a minimum wage job where those who run it obviously don't care about me just so much effort and devotion - I am not going above and beyond the call of duty if it does not benefit me. 2: I am not risking my life (or better yet, someone else's) driving a 40 ton vehicle down the road being a little groggy because I decide the HOS rules suck and I want to squeeze and hundred bucks or so more out of the week. 3: NO trucking company OWNS me, and NO company is the F.M.C.S.A. or the D.O.T.. 4: Another reason for me to be "by the book" is the fact NO company can take my CDL, the D.O.T. can. There is always another job, but there is only ONE D.O.T.. A lot of these companies want drivers to screw up so they can bring on cheaper labor, and (these days) get the subsidy money.

Hummm, nobody is going to tell you when you can drive and when you can't because of some stupid HOS rules? Does that include violating the minimum break time and/or exceeding the maximum drive time? Careful what you say here.

I have had 9 months to get even more educated. I have not just been sitting here typing posts, wasting my time in front of the boob tube, or sleeping all day. I have continued to read every aspect of the safety regulations and HOS regs. I have had nothing but time on my hands to confirm with every different source that I did nothing wrong last year. I should have spoken to the F.M.C.S.A. and/or the D.O.T. when I was given problems in retaliation to my legal and by the book logging. But it's too late now. But if I drive again, I know what to do and when this time. Otherwise, I am agreement with those who have said this is not for me, but for what are probably different reasons than what they have in mind.

If I wash out and also end up getting rid of the CDL and in the process not pay for the school and defaulting, I have a lot of material from here and elsewhere where company and driver rebelious attitudes are concerned where HOS goes. I have saved everything from every source where all this is concerned, and I do appreciate the education I have recieved during my unemployment. No matter who I work for, my logging will be by the book unless I decide I want to sidestep logging line 4 and save a few hours as is so common. Simply, if I am not allowed to work in the industry again just because I am a regs guy and will NOT bend for anyone, I don't feel so bad. And I have a legitmate arguement for the courts if I am hauled in for defaulting and refusing to pay for a CDL I can not/am not allowed to use "by the book".

Anyway, stay safe. I know I seem sharp in making my point, but have no hard feelings tward you just now.

Hey, if we ever worked for the same carrier, you'd be more than welcome to a load I won't or can't run because of being a regs guy :).
 
Just because you stay inside the letter of the law does not in any way mean you are well rested. By staying legal, all you're doing is eliminating the possibility of an additional charge or ticket when and if you do wreck.

The government does not have the best ideas.

Gonna take this from a trillion words to a million for the benefit of other readers, and the fact I think I made my point.

I totally agree with you here, but going by the book will make it a better possibility that I will be well rested. And I agree the Government does not always have the best ideas, but they make the rules, they can take my CDL and/or make life miserable for me more so than the company can. I read the rules, learn them, and follow them without exeption. Like I said, If I am not allowed to work because of that, I don't feel too bad. It's just not for me if I am given a problem for being a regs person. And point very well made that staying within the regs eliminates the possibility of an additional charge ticket if/when I wreck :).

Very true that doing a 10 hour or adhearing to all regs will not stop a wreck. If it's gonna happen, it's gonna happen. But as sinister pointed out, staying a regs guy will eliminate an additional ticket(s)/problem(s). And staying a regs person will give me a better chance of being better rested; and thus, lessen my chances of wrecking. That's the reason for HOS regs.. I don't care what more and more drivers are doing with their logs and such. I am not a sheep, I go my own way, and I should have every right to being by the book without problems from any company or driver. And there definately should - by all means - be someone to tell drivers when or how much they can drive. ABSOLUTLY - especially where heavy equipment that can roll over a few 4 wheelers before coming close to stopping are concerned. I definately agree with the safety regs and HOS rules because too many unsuspecting drivers in 4 wheelers have been killed or mamed for life because of some driver who thinks they can (and should) drive beyond a reasonable limit.I could not live with myself if I did that, so I guess that further makes this not the profession for me in the eyes of some.

Semisweet said it is all in who can do or can not do, I say that it is more that it's what I will or will not do for me personally. If my being unwilling to work more than 70 in 8 makes me lazy, I can accept that too.

Since i've started driving they changed the HOS 3 times and for what reason so they say,SAFTEY.They keep making the laws strickter and strickter.Has it helped????????????????????No it has'nt otherwise they would'nt be coming up with some other stupid program,the CSA 2010.I don't at all respect the law because NOONE forces me to shut down when i'm not tired.Say I drove only 300 miles and now my 14 hr clock is up,I didnt get very far because the shp took their sweet time loading me,if i'm not tired,I will not shut down.There would sure be alot of unhappy customers if we didnt make it to their place ontime because we just had to shut down and take our brk.If I went strickly book i'd be getting around 1000 miles a week if even that.GHow much would u say that is a week after those pesky taxes? Trucking companies are out here for one reason,TO MAKE MONEY.If we drove 1000 miles a week there would be alot of companies that would be forced to close.FMCSA knows this.If they really cared about saftey like they say they do,every trucking company out here would have the paperless logg system right now.They know we cheat and that will not sstop.This is all about money.

Rules are changed to try to make things better and passify drivers. It has not helped because of drivers who think they can go go go and violate HOS regs. And it almost seems that most drivers think that just because they drive, there is no such thing as something called circadian rhythms where they are concerned, and that they are exempt from that natural process. I am glad no one forces you to shut down when you feel you don't need to. If you have worked this way for 8 years and slipped by all that time without getting caught, the enforcement system sucks. But IF you ever do get caught in an HOS violation, tell the D.O.T. officer that no one takes you out of service or gives you a ticket :). I'd love to know how that will fly. And customers know about HOS regs on drivers. If they ask for an unreasonable delivery time, does the carrier say "no problem, our driver will drive 20 or 30 hours nonstop."? Can't make a delivery ontime? That's the fault of dispatch and planners. Can't get more than 1,000 miles going by the book? I don't believe that since I have done 3,000 and staying legal. As for paperless log systems, that will happen eventually with every carrier. Seems that is the only way to keep a leash on drivers who think this is some office job sitting behind some desk and not driving heavy vehicles, and no one will get hurt because of dosing off and slow reaction times for being groggy. I can log on paper and stay legal - I have the discipline. I hated paperless logging because I don't need that extra leash and babysitting. At least with a paper log, you can take a short ride to get some food or other needed things after you shut down. Paperless logging will put you in violation if you do that and you do not have permission for PDT (which you won't always get). I know - been there, done that - and so have you. But hey, if electronic logging is the solution for forcing folks to run legal, then it should be in every truck - every CMV - period. Maybe that'll help save more lives.

Laws are telling you how many hours you are permitted to work - driving heavy equipment on roads EVERYONE travels - period. Laws are NOT telling you when you are tired. This is not some job where no one will be hurt or killed for being tired or reckless. This is transportation where people can be killed because someone else was stupid and trying to be superman/superwoman. Too many "big boys and girls" have gotten people killed. The way I see it is a driver with 10, 20, 30 or whatever years can have a mishap as easily as anyone. Just because someone has years on the road does not make them exempt from the HOS regs. I have flown planes for 30 years, but I still have to adhere to the F.A.A. rules and regulations just as ALL pilots do. That's the way it is, and it is what it is for good reasons.

I write more telling what I WILL do and what I BELIEVE than telling anyone else what to do. And to justify why I do what I do. Frankly, I could care less what any other driver does as long as they are no where near me, my family, friends, or anyone else for that matter - as long as it does not effect me, my CDL, or anyone else who has as much a right on the roads, I don't care. But the roads are traveled by others. Please do drive as you wish, keep a seperate log in the truck. Just be safe out there.
 
Sean,i'm not a runner like it may sound.I don't go go go .I never will do that.I'm just not going to start a stupid 10 brk when i'm not tired.I have never drove a thousand miles in one daY and never will.I get anywhere from 550 too 720 miles a day.The laws do tell us when we need to sleep more or less.After your 14 hr clock is over time to take the 10 because its the law.Many of us are excellent drivers and shouldnt get penalized for the stupid idiots out there but thatll never happen.As far as the paperless goes why dont all companies have it now?because most the drivers out here will quit driving trk all together as well as many companies closing.Highly unlikely we will ever see the paperless logg,too much controversy over it.

LOL, no worries. I am not that touchy. I type 60 to 80 WPM with almost no typos (I can pretty much type as fast as thoughts come to mind). The last post probably took me all of 5 minutes or so - it's nothing. But these days, I can't even get an office job (not that I like being cooped up in an office all day). I also did not intend any offense to you with my posts - I just believe and feel as I do. And what will probably prevent me from being hired ever again is the fact I will mention I am totally by the book with no exeptions. This will avoid the aggravations I experienced with my last job, and everyone will be happy. I timed myself, I typed this in 2 minutes :). Drive safe

I totally agree, and I hated paperless logging. I hate being baby sat to that extreme when I have the discipline to do the right thing. Besides, the paperless logging has more bugs in it than a humid summer day in the Amazon.

I hear what you are trying to say, and to some extent I agree with you. But I also agree that if one has been on duty 14 hours (driving or not), then no one has any business driving 40 tons down the highway after that 14. It does not matter whether you are tired or not, this goes on the law of averages through statistical data, and the F.M.C.S.A will not write laws to accomodate those who can run on only 4 hours or so of sleep for a week or two before really needing to sleep hard. Just the oppisite for those who have a problem with a company making them drive 11 hours a day. No problem for me, but others may have a problem doing that, in which case, trucking is not for them. I am not taking away from anyone's excellant driver status or perch. I too am an excellant driver, and to be honest, if I really wanted to, I can drive 24+ hours straight (I've driven a 4 wheeler 1,700 miles before I finally went to sleep). But as long as we have laws to allow us to rest and not be used and abused by the carrier, I will use the laws to MY advantage as well as the advantage of the motoring public (keeping them safe). Drivers want to drive more because of the low paying nature of this business - MOST professional drivers are not paid what they are worth. I agree on what you say about the electronic logging - I hated it with every ounce of passion in me. But still - if that is what it will take to keep drivers compliant....... It's the majority of drivers who will make this electronic logging more and more common (there's a lot of log violations out there). My position is the F.M.C.S.A. is more than fair allowing a person to spend almost every waking hour on duty, and most waking hours driving (or another way to look at it would be almost two thirds of a 24 hour day being permitted to being on duty). How much more do people want???

LOL, no worries. I am not that touchy. I type 60 to 80 WPM with almost no typos (I can pretty much type as fast as thoughts come to mind). The last post probably took me all of 5 minutes or so - it's nothing. But these days, I can't even get an office job (not that I like being cooped up in an office all day). I also did not intend any offense to you with my posts - I just believe and feel as I do. And what will probably prevent me from being hired ever again is the fact I will mention I am totally by the book with no exeptions. This will avoid the aggravations I experienced with my last job, and everyone will be happy. I timed myself, I typed this in 2 minutes :). Drive safe

I totally agree, and I hated paperless logging. I hate being baby sat to that extreme when I have the discipline to do the right thing. Besides, the paperless logging has more bugs in it than a humid summer day in the Amazon.[/QUOTE]

You got that right about the paperless logg.That thing put me on line 4 so many times and I was either on brk or in the sleeper.Many times i'm sleeping and i'd get the panic button waking me up telling me im in violation.Sometimes sucked calling logs in the morning and getting put on hold.

I'll go ahead and answer you here. But before we get in trouble (or chastized), let's talk about PAM on the PAM thread (I do have posts there). This is Swift. Basically saying this to let the moderators know I understand we are doing a no no here :)

I all fairness and honesty, I can't speak much on a company I never worked for. But I DO have a friend who works for PAM (we went to school at C1 together). He has been with them 15 months and has been mostly happy with them - none of the problems I dealt with. He started with Decker (one of PAM's sister companies), but all the affiliated companies with PAM are becoming ONE from what he tells me. If I had not been dropped (by I more suspect Driver Solutions than Decker), that is actually the company I'd be with. And it IS COMMON that students get dropped from the company they contracted for. Anyway, based on what my friend tells me, I'd say yes, go ahead and give them a call. And IF you get a prehire, and have been cleared to go to C1 under CONTRACT with PAM, and you get dropped while in your first or second week at school. DON'T let Driver Solutions talk you into Swift or Werner (or probably anyone else for that matter). IF you do not get what you have contracted for before you test out for your CDL - GO HOME!!!!!!!!!!! And don't let them say you owe $500.00 (or whatever) for the time you were at school. I could have gone home and not owed a DIME (since they saw I was pretty pissed off). I should have done that and tried again later when a contract would be honored.
