The driver had refused to work beyond the Hours of Service (HOS) limits and reported issues with fatigue and illness. Despite the valid concerns, the company ignored the driver and eventually terminated them. OSHA ruled that three of the driver’s absences were protected under federal law and ordered the company to reinstate the driver, along with back pay and damages.
