I sure wished you had been around back then...I did everything I could think of to prepare for the case...I worried about the clause from the very beginning but the attorney's weren't too concerned about it...

Wow, starting to sound like that wouldn't have done much good. They were either very naive or just figured that the company would settle out of court for some money. those lawyers don't put clauses in there just to waste ink and paper.
 
I don't think it has much to do with seeing how thickskinned someone is for trucking. I think it has more to do with the trucking companies have gotten away with this type of treatment towards their drivers for so many years. It is difficult to stand up to them when they have the big money and you need your job. They know that. Sean try to find a smaller company that will work with you on your experience. They are few and far between but they are out there.

It is difficult when a company is feeding you poop and telling you to like it! It doesn't mean that driving truck isn't for you, it means that you need to find a better company.

This is one area where you are WRONG. I am not too SOFT for the industry. If anything, I am too hard. There is a fine line between being a fool/sucker and taken advantage of, and having to deal with the usual/normal B.S. in trucking. I will not deal with what I don't have to for so little. I DO NOT want everything my way, but I also don't want the un-necessary nonsense just because we are in a bad economy, and these trash companies want to get as much subsidy money as they can before the Government gets wise to what they are doing and cut it iff. They are screweing over people an screweing up lives. That's wrong. All it takes is ANY kind of termination on a DAC for just about ANY COMPANY to pass you up. And these trash starter companies are screwing people by terminating them for stupid and made up reasons, and that's what screws you. So your misinterpretations and ideas of me are what bothers me. I take people like Larry who agree with you with a grain of salt because they are young, not even wet behind the ears, and just wanna be "Billy Big Riggers".

Likie I said, I did not get on this forum to make enemies, get into debates with any know it all road warriors (or wanna be's), be pissed off or abrasive with anyone - etc.. I am here to tell from a first hand perspective what does happen as it happened to me, where those working for some years have no first hand experience of the industry on the entry level these days. I am here to tell those looking to drive for the first time that the reasons are very good that they will be ruined, and I gave the examples of why as they happened to me. To tell that even if they kiss A$$, they will probably be forced out anyway. And to tell even a good attitude will not matter (it didn't for me). It's all because of the creation of jobs that don't exist so these starter companies can keep lining their accounts with money they are not getting in freight now. THAT'S THE ONLY REASON I AM HERE!!!!!!!!! Whether or not I am right or too soft for trucking is not for you or anyone else to decide - YOU PEOPLE DON'T IN ANY WAY KNOW ME.
 
Oh i do not have issues with your outspoken demeaner im the same way and far worse at times but u cant take alittle constructive criticism especially from the veteran drivers also i thank you for calling me a road warrior i consider that a compliment i never thought of myself that way sean when iwas with werner it was the same way swapping splitting getting sent to term and stuck ther for days till mechanics decide its time to actually work i dont see how werner is illegal that paperless tells different and dot does audits thats one of the most legal companies in the industry i tell u one thing my friend youll find out later on down the road if u last in the industry and go strickly by the book youll be lucky if u make 300 a week and thats be4 taxes im at the cust right now waiting for them to get here u dont think ill put myself on line 4 do u just because i cant drop trl and go somewherer as fafr as the paperless goes u knew werner had paperlea be4 u started there

Werner's electronic logging SUCKS. Puts you on duty status lines you should not be on too much. Example: puts you on line 4 when you are driving just because you are stuck in traffic or a traffic light. I quit the daily log corrections on that stupid system. They wanted it, they can deal with it since it was said it was supposed to make things easier for the driver. What BUNK. It was to not have people going over paper logs in the office. Those stupid log corrections are just as time consuming as doing paper logs. Werner is NOT one of the most legal companies in the industry. And if all I make is 300 a week going by the book, then so be it. With all that is going on in the industry now, I'll be damned if I will set myself up for any type of violation whatsoever - and I am not only talking of the petty issues of when I can be on line 4 and when not. And yeah, I knew Werner had paperless logging before I started there. But I did not know how screwed up it was. I should have followed my instincts and told Driver Solutions NO when they set me up with Werner. But I was a newbie thinking I probably had no other options
 
Sean, I can understand your anger and frustation...We've been there ourselves before...The reason things are the way they are in this industry is because people except it as being this way (no offense intended towards anyone).....
My husband started out driving for someone and decided to become an o/o..So we bought a truck and he leased onto a company....We found out REAL QUICK that they did not pay by their contract...There were so many ways they we cheating people on miles and pay it was redicilous...We got angry and decided to fight back....I contacted several attorney's and asked them if they would take the case on contigency...I finally found one that I peeked his interest...We met with several atty's in the office taking in maps and paper work and laying it all out for them...I got enough drivers together from the company to file a class action against them....
The attorney's were so excited because they said "that not only were they not paying by the contract BUT they were commiting FRAUD when they hire a new driver becasue they have no intentions of honoring the contract"...We went to court 3 times and in the end we lost due to a clause in the contract that read "If either party breaches the contract, the contract becomes null and void"....
Our attorney's apologized over and over to us saying "we got screwed and we had a good case against the company"...

I'm not much on sitting back and excepting things either...He has been leased to the company now for the last 8 or 9 years...We have had our issues with them and so have the other drivers...I've contacted the OWNER of the company twice and had 2 dispatchers fired.....I figured if he got fired we had nothing to loose, plus I'm only gonna take so much before I HAVE to speak my mind.....I've alway's said "I might go down, but I WON'T go down without a fight"...

You hit the nail on the head. These companies do what they do because of too many who accept it and lump the problem because they have no where else to go. And I know of any court thing I'd want to pursue would be futile because of loopholes in the contract. I only do it to be a royal pain in the butt with these trash companies for as long as I can.
 
That was clever to the point of being evil.
In essence, there never was a contract, in the sense that most people view a contract - a binding agreement.
That agreement has no bonds or consequences for breaking those "bonds."
It would take a VERY clever lawyer to beat that one. One who could document the history of contracts and the law. One who could prove that while this clause did not violate the letter of the law, it violated the "spirit" of the law - either violation is arguable, but most lawyers only concentrate on the "letter."

It's too bad I didn't know you when this was going on. I could have "schooled" your lawyer on how to win that one.

Oh well.
That leads us back to the point on the previous pages.
When you get beat out of something, whether fair or not, sometimes you have to let it go. You don't have to forget, you can warn those that come after, but to make a success of what's left of your life, you have to go forward.


In some ways, I am letting it go because what is done is done, and will not be undone. As I have said umteen times, I am here to let any new or perspective driver know who reads these threads what has happened, and that they have a strong possibility of not making 6 months in this industry these days. So in that sense, I am NOT letting it go.

Yes, this is well said. And I am sure there is a scant few good companies out there. Trick is getting in BEFORE some trash company screwed up your DAC because (especially now) no one really wants to hire a driver with a termination on a DAC for whatever reason it is there. As they tell you in school and orientation "KEEP YOU RECORD CLEAN". And it is not easy to keep your record clean unless you quit a company who is clearly screwing you. My approach in toughing it out and fighting is not the answer. But I did not deserve a termination either. I am also sure a very scant few find another company after falling through the cracks of stupidity and abuse (even with a termination on their DAC). But that's extreme good luck, timing and location.

"Constructive criticism"?!?! The criticism has NOT been CONSTRUCTIVE because you keep repeating the same thing through your misinterpretations of what I say. You keep telling me that the un-necessary and unfair B.S. has to be taken just because everyone else takes it - even when the line is crossed by the companies. If so, then the industry is far too stupid for me, and in that sense, it truly is not for me. Yet, I will do it only to pay for the CDL as I will not pay for it with any other job. What good is a CDL I can't use? And I see it as a rip off because these schools and job placers know what is going o in the industry - yet tell unsuspecting applicants trucking is doing well. The problem lies in that too many have gone into trucking because they have no where else to go, take the abuse they know is wrong because they have no where else to go, and the companies keep dishing it out and adding to it every chance they get. It's as much the fault of the drivers, as the trash that runs these companies, that the industry is the way it is.

I definately wasted far too much positive energy when all I wanted to do is address those looking to drive for the first time - to tell it like it really is before others get screwed.

I can't take impossibly stupid things graciously. Telling me that just because just about everybody takes this or that B.S., and bends this rule or that rule. And that to drive, we all have to do it with a smile - or just do it - even if it means getting cited. I won't go the extra mile for any company that does not care about me or my CDL (and that pretty much accounts for all of them). They just care about themselves and their money. That and the fact that driving is made more a pain in the ass than it has to be because of too many who allow it is what makes this not for me, and nothing else. As for the line 4 thing: that would have only meant a 34 hour reset once a week or every other week; and ONLY if I used up my 14 hour clock everyday. Well, too bad. If I wanted to work 80 or 90 hours a week (which I say technically you are logging line 1 as much as the company wants you to), I would not have chose trucking. Rather I'd have gotten 2 minimum wage jobs and done just as well. Staying off line 4 is only so the company can work you more. Drivers are not allowed to drive 20+ hours straight anymore, so ways are taught to cheat on logs. Fine for drivers who want to pretend they are on their own time, but not for me. My time is mine when I am home, gone somewhere to eat or shower - etc.. Then I am on line 1

Thank GOD we are done debating. Happy trucking to you, be safe, keep the motoring public safe, and save on that 70 hour for the company.

Get over it we all know they screw people over, but some people get "lucky" and they like it there. It's called "Corporate America"! You don't think these big fortune 500 companies don't try that same crap? Think again they do! The problem today is people are afraid to speak out but from what I gather from you is you seem to complain and drag on the issue. Instead just get out there and beat the street and find a small to medium sized carrier to hire you which I believe was suggested on numerous occasions. I'm sorry to sound harsh! Besides how are we suppose to speak out of you can't get two drivers to agree on what day it is? Until something is done or truck drivers get together (seems like a majority of company drivers don't give a shit) nothing will change!

I have to agree with larry on this.u think u got a lot of bs think again go to puerto rico where I am from and have been trucking all my life.its part of the usa and we got the stupid d.o.t to but u got no hours of service,u get a flat tire and u don't fix it u don't work till u do,u truck breaks down find out what broke so the boss can buy it and u fix it.the broker did not do the ppw for ur load u have to do it or u don't run.work 23 hour days sleep 1 hour and get up and do it all over.I do agree with u that there is a lot of bs but u always have a choice find a way around it and make it work for u.they tried some of the things they did to u with me and I called my lawyer and asked for advice and then I got on the phone with safety and driver relations and talk to them and got most of the things resolved and yes I did have to put up with some bs.there is some sort of bs any where u go that's life.also its going to be very had to run 100% legal in this economy u will have to bend a rules here and there a little bc of the nature of the industries and every com cuting there rates just to get the loads.this can be for u and u can make it work u just need to find a way to make it work for u.good luck
