Deprivation of Rights Under the Color of Law

the feds need to get involved in some of this bullshit..

Seriously? It's advisories from the federal level that resulted in the order that she violated.

This is a perfect case of civil disobedience, the way it should be done. no violence, no riots, not looting other people's stuff. She stood her ground, she didn't back down, and she proudly went to jail. She will come out of this better for it as a result because the community will reward her.

Her fine has been paid, and people were in line to pay it if someone at the top didn't do it.

People will remember this next time lockdown orders are forced upon communities.

And she is out now, by order of the Texas Supreme Court. Released to a large cheering crowd.

When I heard her response to the judge I wanted to ask him if he would have jailed Rosa Parks.

The fact that he jailed her, I don't have so much of a problem with. It allowed for her to take her stand and expose the ignorance of all these insane orders.

What bothered me about this judge was the demand that she apologize for being selfish. Not sure where the judge got off thinking it was ok to shame someone like that.

The thing that bothers me she had for a long time. I’ve emailed my senators and congressman about is is that these are not laws but “orders” put out by an unelected unaccountable bureaucrat. Look at the FMCSA that we deal with, we were never intended to be under the authority of anyone. Laws are supposed to be passed by our representatives that we can vote for.

He would not be the first judge to use shame in court.

One of many articles on court ordered apologies.

That judge is on a serious power trip and needs to be removed from the bench.

Maybe.

What was the judge supposed to do?

If the order is being violated, it's a public situation, and you let it go, you know that everyone is going to wave their middle finger at the order.

This isn't about whether you agree with the order or not, it's about how do you do your job as a judge in that situation when you are faced with civil disobedience and the person is going to refuse to comply?

You’re probably right but he seemed to be taking it personally.

Yeah, reminded me of the judge shows you see on TV.

That said, not a position you want to be in as a judge.

This one let his opinions cloud his judgement, IMO. he believed everyone should be isolated, so rather than just judging on the merits, decided to throw some shaming in on it as well, based solely on opinions. I say that because we are all over the fence on how we should be handling this.

The defendant was not in violation of any valid, constitutional law. Therefore it was the judge's job to dismiss the case.

Duhh. 🙄

It was an executive order delivered at the State level. I don't think it is expected that new laws are going to be passed during a Pandemic.

This all played out as it needed to. The order was BS. The business owner called the state out on it. The judge ruled as if the order was lawful.

The Texas Supreme Court ordered her to be released from jail. That said, they haven't said the order was in violation of anything, so this could come up again if another lockdown takes place.

I'm just very proud that Texas ended up being the place where this sort of confrontation actually went down. Meanwhile, millions of Americans whined and complained but did nothing.

It never should have needed to go all the way to the state Supreme Court. The arrest never should have even been made. The cop who arrested her is guilty of a civil rights violation and in my opinion should be charged with kidnapping.

We do not live in a dictatorship. Not even at the state levels.
