Confirmed: E-logs suck

Then we probably are "stuck with it" for the foreseeable future....Americans have been so dumbed down by the public education system, and are so soft and weak, that there aren't enough strong, freedom loving Americans to stand up for what's right.
Dumbed down.. don't be so polite... we got obama for president....

There is no 'safe haven' grace for a line 4 violation. There are a few reasons why things like this happen:

Shipper:

Holding a driver for too many hours then asking them to move.

Driver:

Inadequate trip planning. Why on earth do drivers deadhead more than 200 miles for a pick up? Refuse the load.

Not knowing the regs. Try to squeeze an 8-2 split in. Don't sit there for 10 hrs when you don't need to.

One more note:

The ELOG isn't the problem. It's just a messenger. The HOS regs are the problem, and company/customer policy adds fuel to the fire.

Just because you went over on HOS with an ELOG doesn't automatically conclude you're getting CSA points, either. You may get a lashing from the company, but you won't get anything from the DOT unless they catch the violation during a level 1.

I have done that many times because I wouldn't haul cheap freight. I would take a real good paying load into a cheap area with the intention of deadheading out when I took it.

There are way too many people that will haul ridiculously cheap freight because they think they'll lose money by deadheading.

Those are the idiots that keep the rates so cheap.

Yep. We routinely bounce back to GA when we unload in Miami because the rates are sub $1 to get out of there. Unless we grab a customer load. We just charge enough to make the bounce worthwhile.

I believe you mean line 3 violation.
1) Off Duty
2)Sleeper Berth
3)Driving
4)On Duty Not Driving

You can be on line 4 from now until the next ice age and not be in violation.

No sir, I meant line 4. There aren't any exemptions for line 4 besides the short haul exemption, which doesn't apply here. True, you can be on line 4 24/7/365 and not violate anything, but you'll get the line 4 violation if you drive before taking the proper break.

Line 3 violation just means you drove more than 11 hrs without a break. Drive for 7 hrs, stop for 7 hours, you'll get a line 4 violation when you drive.

Your on duty driving and 14 hr clocks are two separate clocks that aren't integrated. Even when you're on lines 1 or 2, that 14 hour clock will still tick until you log enough time for a proper break.

No! I will take my mandated 10 hour break, Thank You. By the time you do everything you need to do, You may only get 8 hours sleep. I am not about to let anybody push my to split my sleep, Dispatch or otherwise.

Really? wow! No foolin'.? Thank you for that breakdown.

Yeah @THBatMan8 I understand the 8,11, and 14 hour clock. However you can not be placed in violation of anything unless you go to line 3 after the end of those time clocks without a qualified break.

To put it simply you will never receive a violation for being on line 4. Never. You can only be violated for attempting to drive in violation.

If you're at a shipper, you're not going to have that choice. If they ask you to leave the property, you need to leave regardless of how much time is left on your 14. If not, they can have you arrested for trespassing and have your truck impounded. I've seen it happen too many times.

Yeah, but they only winged him to put everybody on notice that they weren't screwing around.
3 or 4 guys got tased for not moving fast enough or whining that they were innocent.

I heard that they even shot the cop a couple of times that was trying to make him leave.
The cop was then fired and is now doing 10 years for "Interfering With Interstate Commerce".

Them Fedrul Marshalls are really sumpin.:2guns:
