OOIDA: We don’t support California AB5

The Owner-Operator Independent Drivers Association reached out to its members on Monday, Nov. 18, to clarify its position on a controversial California worker classification law. In a letter to its membership, OOIDA made clear that it never supported California’s Assembly Bill 5 and that it is ready to fight any negative impacts the law could have on its members or the trucking industry.

“There continues to be much speculation and misinformation regarding OOIDA’s position on AB5, which is California’s new law intended to address worker misclassification,” OOIDA wrote in a letter signed by President and CEO Todd Spencer. “While the law applies broadly to dozens of industries in California, in trucking many people believe that AB5 could potentially end the leased owner-operator model as we know it.

And it was there comments early on that caused all this speculation. AB5 is a huge mess that is nothing but bad for owner operators in California, and every association involved with the trucking industry should have been fighting this with all they had from the very beginning.

There are actually a lot of good conservative people in California. They are out numbered by the crazy ones and the way the voting districts are laid out have them at a serious disadvantage. I think a bunch of us need to go there and buy homes just to take the state back.

Generally, those unaffected are not contributing to the tax base. So they'll get squeezed. They won't be able to sustain themselves.

I'm sure there are some good parts to this new law. I know some companies take advantage of individuals and make them claim to be a contractor when they are not. They are actually employees. It does happen in construction a lot. I'm sure some of the politicians meant well when they were doing it. But it is horrible for trucking. They need to fix that.

If I am correct, California is trying to correct the misclassification of workers as contractors.
The brush they are using is too broad. Yes many drivers are working as 1099's when they should be W2's. That may not apply to O/O's and other business owners
Here they are calling it "driver inc." where companies want to pay drivers as contractors and they are misclassified as far as employee and the tax agency is concerned.
I may be way of the mark here. But I should get credit for 1099's and W2's
