New EOBR Petition Thread

I didn't start a new petition.

I started a new thread because the Boss accidentally deleted the spirited discussion we had going. Heh...

There are already more than 3 of us opposed to EOBRs becoming mandated. In fact there's 64 at this point in the venture. 64 > 3.

Here, ... I'll save you the trouble..

well considering the total need is still not met, this is no victory. (25,000 needed), and a mere 64 voted..???

thousands are still needed, and do not forget, that a number of those already "signed" will be discounted as duplicate "votes".

i'd put the number of actual signatures that would be "acceptable" to oh....40......

gallant try, i had said so long ago...but it ain't gonna go no where's.

Does any body recall what happened when the revised HOS regs were thrown out by the court about 8 years ago? An 8 year old question may seem too old to sweat, but maybe it's not. Some crimes have no statute of limitations. If what happened 8 years ago has a strong bearing on the present HOS situation, then it's relevant today.

Anybody remember? I have a clue or two, but I'd like to hear more about it.

I don't even remember what I had for breakfast yesterday.

I just remember I hated that 5-on/5-off crap when I was driving for Roadway. They'd stick two randomly chosen drivers from the "extra board" and send us to freakin' California & back, and the policy was that if either guy wanted to run 5's, we both had to. After the 2nd or 3rd iteration, that just wasn't working for me. For every hour of sleep I get in a parked truck, I'd need 3 hours in a moving truck. I can't sleep in a moving truck, period. Running 11's worked better because after about 5 hours of lying there with my eyes closed, I might actually get a few hours of sleep. I was glad when they got rid of the 5-5 split, but actually I was just hoping they'd keep it, but just make it so you can't do it indefinitely. After the 2nd or 3rd iteration, a required 10 would be fine.

I was not in the transportation industry eight years ago.

Maybe blackw900 knows. He's been truck'n since 20 mules went into the desert to fetch borax.:toothpick:

It has already gone somewhere for the three score & four who signed it.
It's the difference between cowering behind the dumpster and taking a swing at your pursuer IMO.

Next month there will be changes to the CSA risk assessment B/S because a lot of people were relentless in criticism of the hair-brained methodology. Do you suppose they did so because of an altruistic desire to be fair and even-handed to their subjects?

No. They did it because of a united effort to expose and expunge the heavy-handed way in which the arbitrary judgements from on high were being passed down in the guise of edicts from the sovereign gods of safety and public interest.

They did it because of relentless pressure from groups and individuals.
Back in July an OOIDA member read FMCSA their 'Miranda rights'. :holdflag:
Which is a big part of the reason for FMCSA's revision of practices. :monkeydance:

And there's more to come.
OOIDA has a suit pending now to force FMCSA to remove violations which remain even after an accompanying citation has been adjudicated AND WON in court which is only reasonable...
except that FMCSA doesn't see it that way until a judge opens their eyes.
If there would have been enough grassroots opposition to such nonsense FMCSA might have been pressured enough to avoid the suit freeing up resources for other important battles.

So you and your defeatist attitude can take a flying kiss...
I gotta go.

I might be mixed up but I believe it was thrown out because of FMCSA's failure to study/cite the HOS effects on the health, safety & welfare of those subjected to the (new) HOS rules. :faint:

I get your point but strikes and petitions have never really worked. OOIDA on the other hand knows the right people to pay(off) in washington and this is effective. If more people would join OOIDA we could have a stronger voice and effect common sense changes. But truck drivers aren't necessarily mart enough to do what is in fact in their better interest. We have had this discussio many times.

Right.
But if we would make the earth move by following up on the call to action notices much of the litigation would be unnecessary.
That would free up a LOT of resources to pursue other injustices.
OOIDA is a lone voice in the wilderness as far as organizations who defend the rights of individual drivers...
and we're up to our ass in alligators!!

You're making me late dammit!!
I'm outta here... :tiptoe:

What the hell are you talking about? :dunno:

I thought there was a rule where teams had to have a period of 4hrs per day when neither driver could drive. This was so they would at least get that sleep uninterrupted. I could be wrong or maybe they changed it.

I drive teams have had my logs looked over (yes on e-logs) and was never told about this rule. And the hubby and I don't have time to stop some days.

That sounds familiar. I think it was Public Citizen and maybe another group or two who brought the matter before the court.

The court then threw out the 2003 rules. I think I remember that ultimately the court upheld the 2003 rules. In the meantime, however, the split sleeper berth provision was cut. I remember hearing something about the court saying that only procedural practices had been violated. Maybe that's where the failure to study/cite the HOS effects on the health, safety & welfare of those subjected to the (new) HOS rules came into the picture.

The thing is that I have never heard or read anything that claims the elimination of split time to be the action which satisfied the judges. I've been wondering for years and researching when I get the chance, but can't find anything.

So bought off politiians are cool so long as your doing the buying. I mean I know that is what Orida is trying to do and it has two very fatal flaws.

The first one is flat out lying to their members. Eventually the members see through their BS and decide to take action themselves.

The second is if you want to get into a spending war buying your politicians your going up against companies like P+G, PepsiCo, Kimberly Clark, SC Johnson, Coca~Cola.........

Folks these people spend more on keeping their employees stocked with toilet paper per day than OOIDA's annual budget. So you keep whining about bought and paid for politicians, all the while hypocritically trying to buy your own through those people whom keep you bufffaloed. I am sure you will garner the exact same results achieved to date which when examined outside of their quaint little puff paper is slim and none.

Yep. The only people who complain about organized crime are those who don't benefit from it. As you mentioned: the big companies are doing it, and that's how they get what they want from washington. That's the game and if you want YOUR voice heard you better learn how to play. Its a simple case of follow the money.
