Texas Supreme Court to Hear Werner Enterprises $100M Nuclear Verdict Appeal

Wasn't the driver that lost control also intoxicated?

I think I heard that somewhere. I just don't understand how if someone ends up going the opposite direction of the lane of travel and take away the right of way for traffic traveling properly how the traffic going the correct direction is at fault.
I think they lost control in the snow or ice.

But I could be thinking about a different case that was in the news.

The lost control on the ice is a fact, but I believe when this first blew up they found the driver was also impaired. I could be wrong that's been quite some time ago. My memory ain't what it used to be.

Yeah.

I'd need to read the original news reports again.

Another one just hit the news. Wabash got hit for $462M for 2 guys who were unbelted and drunk (which the jury wasn't allowed to know) ran under a trailer at ~45mph.

This insanity has to stop, being completely legal & not at fault is no longer a guarantee some jury won't clean your clock.
How is that even possible that crucial evidence is disallowed?
I mean even the worst lawyer in the world could beat that case if the evidence of them being drunk and causing their own injuries was allowed.

That's probably how crooked civil court judges get vacation homes in the Caymen Islands.

Or maybe the ambulance chasers bought the judge a trip to Epstein's Island.

There's little chance of it being legitimately explained otherwise.

I haven't gone and dug into this very deeply, but I would bet you a night at the bar that the lawyers made the argument that what caused the accident didn't matter and shouldn't be allowed to Prejudice the jury
