"Nuclear Verdict" Forces Arkansas Carrier RCX To Cease Operations After 19 Years

A family-owned Arkansas-based trucking company closed its doors on March 2 after notifying its customers and drivers late last week.

Randy Clifton Jr., president of RCX Solutions Inc. of Little Rock, Arkansas, confirmed the news of the closure to FreightWaves on Monday.

"We got everyone home and they were all taken care of last Friday [February 28]," Clifton told FreightWaves.

"The Beginning Of The End"

On January 9, 2015, Clifton said one of RCX's trucks broke down while en route with a load of empty L'Oreal cosmetic cases.

Clifton, who also owns a brokerage company called Sunset Transportation, brokered the load to an outside carrier, About Tyme Transport Inc. He said he "did a trailer interchange" with About Tyme's owner-operator, Ronald Brown, to finish delivering the load to the customer's facility in Little Rock.

However, while Brown was in transit with the L'Oreal load near Refugio, Texas, his tractor-trailer hydroplaned, then crossed the median and jackknifed, striking a Dodge Ram pickup driven by Alexandro Puga, according to court documents. Both vehicles caught fire. Puga, who was 29 at the time of the crash, sustained several broken bones and third-degree burns. Brown died at the scene.

Nuclear Verdicts are so out of control at this point.

Since most will fail to read the article, it's important to know what happened here.

The Carrier that is going out of business, RCX, isn't the carrier that had the accident. They had a truck break down, and since the carrier also has a brokerage, they brokered the load, via a trailer interchange, to another carrier.

The other carrier had the wreck, got sued, and when that wasn't enough money, the carrier that owned the trailer got sued for a massive amount. An amount that would put any small carrier out of business.

put out of business all because they did the right thing by trying take care of the customer and get the load covered after an equipment failure.

I honestly don't know why common sense can't come into play in these situations.

A stupid judgment like this is like saying the trailer caused the accident.

The driver is in control of the truck.
The truck does what the driver tells it.
The trailer follows the truck and driver.

Gotcha ...never been there though back running Laredo I often stopped at North Little Rock and that company actually "preferred" ya fueled at TA/Petros..

Once in awhile that grab n go counter would have "Brisquet" and that old black lady would like fill a container and it was only $5/$6 bucks..

Wasn't bad heck quit decent actually by Grab n Go standards...

All it needed was some Xtra BBQ Sauce other than that "Melt In Your Mouth"..

But ya hadda walk across the street to the PEE-LOT for a Beer to wash it all down

Just a guy set up roadside raising money for his wife's medicine..

Even the Cops pulled in and ate so I figured it was okay..

Best Ribs I ever had and his wife has some rare cancer and that's a good cause too...
