How to fight Bad Dac reports and References

Hello, I'm sure hope you guys could answer a serious issue for me. I have been in trucking two years and worked flatbed for Swift transportation and arrow trucking. Had three non reportable nonfatal accidents in that time and Been dac'd as unrehirable, unsastisfactory safety record, and terminated. I 've have tried to get on with other companies and have had no results. I have even been to a lawyer who tells me that there's nothing i can do to rebut or correct my record. I even hired Dacfix to clear and/or correct my record and they did not even work. I am getting suspicious and just plain fed up. In your opinion what can I do to Ressurect my trucking career after being dogged by two of the most vile carriers that bottomfeed on new drivers? What means can I use to do it?

From what I gather reading other posts, you can write A rebuttal.Much like A credit report you get to tell your side of the story.
Were these incidents your fault? If so,3 in two years maybe the problem. With the industry being in the state it is,carriers are able to pick and choose alot more now. They can hire you with 3 incidents or they can hire someone with none.Easy choice.
I don't know the circumstances and whether you were at fault or not(and I aint sayin you were)but I think you can see what A carrier would be looking at.
That said, not every carrier uses dac(or whatever they are called now)your best bet may be to look at A smaller outfit who doesn't use this service.
Hope it helps.Best of luck.

dac which is hireright now doesnt matter now anyway, former employers release accident info straight to new employers and the fmcsr regulation book says its mandatory for past 3 years. 390.15 section says company can report minor accident information according to company policy, somehow something needs to be done about this rule, i got 2 prevantable accidents their releasing that were just getting stuck on pavement in bad weather, we're all fk'd

If your record in not over 7 years old, you need to submit a rebuttal upon your dac. They are required by the FTC to allow you to post a rebuttal upon the record you have disputed. If you have 3 accidents on your record with in the last 5 years, your fault, their fault, equipment failure, it will not matter because to most large companies insurance cariiers that just made you a high risk and untouchable.

The best you can hope for in a worse case senerio is to find a company that does not use DAC service for background verfication or go local until the time comes that you are hireable again. You may also not be aware that like your credit report DAC is required at your writen request to purge their records, meaning they have to drop all information from their data base that is older the 7 years

In reference to the reporting of an inccident just for you getting stuck, if you check with your safety director, any incident causing over $2500 damage, or involving another vehicle of private property is a reportable accident under safety regulations. As well as any incident requiring the on site of a tow truck/wrecker. I don't agree with it, but its been there for years

actually cost of damage doesnt matter anymore for accidents being reported by companies. its just disabling damage, which is anything where the truck or other vehicle cannot continue without repair. as your license goes, depends on the state, im in ky and they go by 500 dollars damage to be reportable, fmcsa has a b.s. rule where companies can release any minor accident info according to company policy, im blacklisted myself right now and am fighting my former company as relentless as i can to make a statement, just gotta keep fighting

Those safety directors from any large carrier are nothing but a joke. You could fight and fight but at the end you lose. They all stick together.Theres a few minor mishaps I did with this company and I will take full blame. Was from not paying attention. When I know i'm in the wrong i'm not afraid to admit it.Small companies don't put things on your dac.Big carriers not only put accidents on your dac but they elaborate on everything. Then other carriers won't hire you because they do the same exact thing to poor unfortunate drivers. Then af course FMCSA lets them get away with it.They're against the drivers like everyone else is in this god forsaken place we call America.

fmcsa sucks, they made the rule that companies need to release accident info, but when a company releases wrong information, they wont take those complaints, only take complaints if theres a safety issue. ruined my career for 3 years and denied unemployment, said accidents are misconduct because they showed the smith system video. im fighting anyway just for the principal. we really need lawyers just for truckers and accident reporting, and drivers out there, stay far away from milan express of tn. if you have the smallest incedent, they will crucify you. they are a true satanic company!!!

check out everytruckjob.com lots of listings for jobs there.

I agree!
I have found several driving gigs through this site.
The best way to fight the DAC BS is to keep getting jobs. Anything bad on your report will look conspicuous if you continue to get jobs in spite of what some people have reported. The ones who report bad things about you will appear to have a vendetta, and appear less credible.
In straight speak, the ones who report bad things about you will look like the hate-mongers that they really are!
Thats how you fight DAC!

My mvr and dac is greatly tarnished.I'm unhireable by any of the major carriers till at least another yr thanks to Gainey. But u know what that has'nt stopped the smaller companies from giving me a chance the last company closed due to the economy. But this company im at now hired me and I proved to them that they made an excellent choice hiring me.I'm making more money then I ever have with any of the large carriers. So those of u that think it's pretty much hopeless finding a company,it's never hopeless u just can't give up but don't depend on the internet for help. You need to get off your lazy asses and hit the pavement if u really wanna ever drive trk again.

Thank you for making my point Patty!
DAC wont stop you from finding work as a driver, unless you let it!

It is my understand that DAC is a report from a private company. Most if not all states have small claims courts where you can file a case for a minium investment. No lawyer is needed. You can file a claim against the Company who puts false information out. In some states you can ask for as much as $15,000. You can file one claim against the trucking company and one against the DAC people. If everyone did this, it would stop the practice. Big Business only does bad things to people when the people allow it to happen. Invest a little time and less then $100 and screw them before the screw you.

I like the advice about taking them to small claims court. I'll will try that. But as far as federal regs, they are clear. Accidents are not those indidents that are self inflicted and dont' involve $500 or less in damage or what is considered by company guidelines. Because as far as the company's concerned anything is a accident. They get picky because they are trying to get rid of you and discount and disqaulify you for any reason. Especially if you make one year at a bottomfeeder. I have a friend who sent in her two weeks notice and during the last two weeks of her time with the company they made her do hot loads overnight which she was weak at doing. One of those hotloads she could not complete and she ran late on it. They gave her some more hot loads until she her truck broke down. She asked if not demanded that her truck be fixed before running another hot load. Her dispatcher fired her and she probably got a service failure. Then she left to go to the new company and went to orientation. While in orientation she had to take a company phsical ad they found out she was taking some doctor/prescribed drugs for her anxiety. Hell she even brought a note for the doctor signed and notorized. The company doctor refused to pass her inspite of her note from her doctor and the company sent her home. See how screwy these companies can be. Gotta watch these days.

I think i mentioned small claims court i was going to take gainey to court after second notice when court was that an offericer personally gave mr gainey a week later i got all the money that was owed to me so i dropped the charges i agree companies r screwy big ones as far as i can tell if drivers would just fight for their rights instead of allowing companies to screw u over trucking wouldnt be too bad but theyd rather just quit or get fired and not do anything about it so what if they have high priced lawyers doesnt hurt to fight if i hav a major issue none of this talking it out ill let the courts decide
