There would be no cap on physical damages, just non-economic( AKA punitive) cap of $250,000 and limiting Attorney's fees. Not enough of a limit IMHO, but it is a start.

So, let's say you loose you're ability to earn a living through a medical mistake...

Lifetime earnings are considered part of the physical damages. The standard is 75% of projected earnings to age 67 when figuring for the filing. A jury can adjust that amount up or down allowing for projected increases in income, or extending expected career. They can also reduce it if they feel a plaintiff may make a partial recovery later.
What is capped is juries deciding that they should arbitrarily punish folks. The way it is written regardless of what they award it is capped and they are not even informed of it in court. So they can still have the screw Aetna mentality and award multi-millions of dollars for a case but they would only pay the cap.
