Con-way agrees to $3.5 million settlement in rest break lawsuit

After a legal battle that lasted more than six years, Con-way Freight Inc. has agreed to a $3.5 million settlement for approximately 1,000 drivers who accused the carrier of denying them rest breaks, according to court documents.

In November 2009, Monterey County, Calif., residents Jose Alberto Fonseca Pina and Rogelio Vigil filed a lawsuit alleging Con-way denied drivers adequate breaks per California law. Pina and Vigil had been delivery drivers for the company since 1995. Both were paid approximately $20-21 an hour and claimed wages did not compensate for missed rest breaks and meal periods.

I wonder how many of those guys will rush out & buy expensive toys before they do the math and realize they're only getting $3500 each.
 
After the lawyers collect their share, plus taxes, they'll be lucky to clear $1,500.


Sure not a "Windfall" by any means yet it's LAWSUITS like this and Hundreds of other that set "Legal" Precedent on the Docket for the FUTURE
 
It's not about the money per se, it's about kicking these companies in the nuts until they do right by their employees.

And $20/hr really isn't all that much anymore. I mean yeah it blows the doors off being inside the warehouse for $14 but it ain't like the extra $6 makes you wealthy.
