After a legal battle that lasted more than six years, Con-way Freight Inc. has agreed to a $3.5 million settlement for approximately 1,000 drivers who accused the carrier of denying them rest breaks, according to court documents.
In November 2009, Monterey County, Calif., residents Jose Alberto Fonseca Pina and Rogelio Vigil filed a lawsuit alleging Con-way denied drivers adequate breaks per California law. Pina and Vigil had been delivery drivers for the company since 1995. Both were paid approximately $20-21 an hour and claimed wages did not compensate for missed rest breaks and meal periods.
