in this mornings news paper, poot shops are about to open in MA... they are (now seemingly ) worried that many will drive while high.


here is my question, especially for those of you that live in weed legal states...

"can you sue the state, IF a wreck happens with a driver high"?

i would think so, since weed IS a drug.

i know that drinking is legal, of course, not drunk driving, but here they are KNOWING full well, that many will drive while high on weed....

does that MAKE the states liable and open for a lawsuit??

With pot shops opening soon, state warns about driving high

I would say no. Alcohol is legal and I don’t hear of many lawsuits against the state after a pedestrian is run over by a drunk. People are responsible for their own actions.

ok, but pot/weed is a KNOWN drug, that many states are legalizing....i cannot recall alcohol being known as or called a drug, and it's been "legal" for generations as long as age requirements are met. it's not like one day, all the states said, "let's legalize alcohol"....

all they basically said, "we will allow legal age limits"....

while i agree with dave, i am not sure if a legalized drug makes the state(s) blameless.

No. Local, state and federal governments are all indemnified from being sued over **** poor choices made by citizens.

People drive so totally drunk, that they can't come up with a good excuse for driving totally drunk. People are going to make **** poor choices, and the use of a drug whether it's pot or alcohol (yes, it is a drug) really isn't at question.

Given the choice of driving near a drunk or a stoner, you're probably less in danger from the stoner.
 
Doesnt matter if its legal. Like alcohol, you cant be under the influence of it while operating a vehicle. Plus it stays in your system longer than alcohol, so id say stay away from the weed if you plan on driving a truck.
 
People take prescription drugs that they are in legal possession of and can impair their driving abilities, but I never hear of the State being sued.

If you're driving a truck, pretty much any consumption of pot is going to show up in a DOT drug test. That's pretty much guaranteed to end your driving until you've shown you can stay clean.

Your state may have legalised pot for medical and/or recreational consumption, but for any transportation worker required to meet federal medical standards you are still screwed if you provide a hot sample in a DOT drug screen.
 
I like to keep a clear mind,as much as possible.i don`t take pills but i do take goody powders

enough can go wrong with a truck at any time
 
1 alcohol is a known drug same as nicotine, both are legal.

2 no you can’t sew a state for some dip shit driving on the weed

3. If they open smoke shops where people can smoke there then leave, they have the same liability as a bar.

4 most dispensaries do not allow smoking on their grounds so they sell it to customer and customer makes their own decisions there after.

As far as an increase in DUI OUI or whatever your state may call it. Arrests and convinctions haven’t changed much only the amount of people being incarcerated for weed possession.

On October 17 2018 weed will be legal in THE Canada nationwide. There are some concerns from the think of the children crowd.
Not much will change. There will be those that use and will be responsible and those that are not, The same with alcohol.
Impairment is impairment beit you are tired or sick or on prescriptions or drunk or high.
 
but you see everyone, what i was trying to convey, is that the states KNOW, it is a drug. what effects it has on some people, what it could lead to (in much more potent drugs), and they are legalizing it.

(forget about medicinal weed, for cancer people....or glaucoma...)

so are the states in effect in doing so, culpable for or "enabling" a society where drug users can cause destruction, and be liable in the courts because they in essence, "allowed a known drug" to be legally used?

what would be next.?? crystal meth, heroin, LSD..??? (etc, etc)

alcohol does have effects on people, i get that.....but alcohol wasn't really an illegal substance, it WAS prohibited back in the years of old, then reinstated.

moonshiners were making/selling shine, illegally, and avoiding taxes, and becoming the fore fathers of nascar, so we can leave shiners out of this......(which by the way, has some of the BIGGEST alcoholic beverage companies sponsoring it.)

Weed is not a gateway drug as many would have you believe. It is a take it or leave it kind of thing. I socialise with people that smoke weed in front of me and there is no craving. Now tobacco on the other hand is another drug and I can't stand around smokers without getting a craving of my own.

frankly, anything can be addictive, if one abuses it.

i was looking at an "enabling" and culpable way to nail the state in any sort of car crash, where the weed is legal. you know darned well, the lawyers crawl up our butts for any TINY SHRED of wrong doing on our part, why can;t we do the same in a legalized weed enabling state. ?

That crap that marijuana is a "gateway" that leads to all kinds of other horrors is made-up BS. Why? Because the people that peddle stories like that have an interest in maintaining its illegality. Law enforcement primarily. They will incur a decrease in their budgets, and a loss in revenue of confiscated property without due process.

The so-called "war on drugs" is a colossal failure. It has become a war on the citizens.

Yes it was constitutionally illegal for many years then allowed back,

They are doing the same thing with weed.

You still have shiners and bootleggers, your always gonna have people illegally growing and selling weed.

I’m sorry having smoked pot for many years when I was younger you will never convince me that it leads people to do harder drugs.

An addict will be an addict no matter the substance and will do stupid things with over consumption.

Trying to figure out a way to nail the state for the purpose of sticking it to them, fine I’m down, but I am on the weed should be legal bandwagon so I don’t support your efforts here, sorry for that.

Do you know how many people who suffer with PTSD would benefit from a nationwide legal status. Especially vets who are afraid to get help.
 
My late ex suffered from type C heppititus she contracted from a blood transfusion she received in her 20's. When she was 35, it flared up, and she was deathly ill. There was no treatment for the disease at the time... you just had to ride it out.

One problem: she had no appetite, and what she did eat came right back up. She was slowly dying. Pot, the evil weed to the rescue! There was no such thing as medical marijuana at the time, but doing a blunt would get her hungry and suppress the nausea afterword.
