Appeals court to hear OOIDA's case against U.S. DOT

A panel of judges for the Eighth Circuit Court of Appeals is set to hear oral arguments in the Owner-Operator Independent Drivers Association’s lawsuit that alleges the Federal Motor Carrier Safety Administration bypassed the rulemaking process in order to regulate obstructive sleep apnea.

The arguments will be heard by Judges Duane Benton, Bobby E. Shepherd, and Jane Kelly for the Eighth Circuit Court of Appeals on Wednesday, Nov. 15, in Omaha, Neb. Sushma Soni will be the attorney for the U.S. Department of Transportation, and Paul D. Cullen Jr. will represent OOIDA.
